Interesting discussion.  My only comment is this:  Apple has opted to 
replace sendmail with Postfix for MacOS X 10.3, and they're pretty 
paranoid about licensing issues.  Apple has a couple billion USD in the 
bank, so they're quite a lightening rod for these kind of law suits.  
There is no way their legal team didn't carefully consider liability 
issues before making the switch; if they felt there was ANY increased 
liability whatsoever it never would have happened.
