A) Consult your lawyers. If you're pursuing commercial ends without legal
counsel, expect headaches.

So I wouldn't expect any major problems in incorporating OpenSSH into
a commercial product.

Err, encryption of the packets would have to happen on that server.
So, yes, there's a way, requiring the administrators of that machine
add that capability. There's no way to unilaterally encrypt incoming
packets.

Without more information (like, say, the relevant error messages),
no one here will be able to say for sure. What version of the ssh
software are you running? Is protocol 2 support enabled? Do you have
a dsa host key?
